Each January 28 citizens and businesses of countries around the world honor the the importance of protecting privacy on the Internet for Data privacy Day. Data Protection Day (DPD) is an international effort centered on respect for privacy, data protection and enable trust.

As supporters of Data Privacy Day, Golden Frog is to use important today to call on Congress to update the Privacy Act for Electronic Communications (ECPA).

ECPA defines the rules when the police and the government can read our e-mail, look at our photos and access other documents stored in the cloud. It remained unchanged if the incredible technological advances of recent decades and left our communications open to unwarranted government intrusion. Surprisingly, ECPA was passed in 1986 and has not been updated since.

As the law is written now, government officials and law enforcement can access personal communications and documents stored on the web with just a subpoena, which means no prior review a judge is required. This massive vulnerability in private life opens the door to espionage and government in defiance of our Fourth Amendment rights. In a country based on freedom of the person, which is unacceptable.

As we celebrate the Day of confidentiality of data, it is important to recognize that this invasion of privacy must be addressed immediately. The Americans have a reasonable expectation of privacy on the Internet and it is imperative that the wait is satisfied.

The last Congress, much progress has been made to update ECPA to the digital age, but the reform has failed. bipartisan bills have been introduced in both houses. A bill in the Senate passed committee but never reached the floor while a home version of the bill has attracted an astonishing 270 co-sponsors. Incredible process was made but Congress must act this year to adequately protect the privacy of Americans and see that our rights over the internet will finally be sufficient for the digital age.

It has been 29 years since ECPA was enacted. The reform is long overdue and there is no better day to focus on the need to protect the privacy of individuals online as the data privacy day.
